Terms & Conditions

The terms and conditions detailed below apply to all bookings made with Penicuik Estate LLC, whether via www.penicuikestate.com, by telephone, email or otherwise. Please note that for promotional bookings, the relevant additional terms and conditions should be consulted.

When you make a booking, your contract (which shall include these terms and conditions) will be with Penicuik Estate LLC.

All rates featured on our website or quoted by telephone or otherwise are offered subject to availability and we reserve the right to refuse any booking for good reason.

Only adults 18 and over can stay at the Estate unaccompanied. All prices are subject to availability.

No bookings are confirmed until receipt of the deposit.

Our packages and pricing fluctuate depending on availability and demand at any given time. All prices are subject to change without notice. Prices are subject to availability and are inclusive of VAT at the current prevailing rate. Your price and reservation is guaranteed once you have been given a confirmation number and paid your deposit. Certain dates may be subject to a minimum length of stay. All rates are subject to availability.

Separate terms and conditions may apply which will take precedence over these standard booking terms and conditions.

We recommend that relevant insurance is taken out when making a booking, even when payment is made in full.

Check in is from 3pm on the day of arrival. Departure is by 11am on the day of departure, unless otherwise arranged, and subject to availability.

We are responsible for providing the accommodation.

We accept no responsibility for personal injury, death, loss or damage to personal property (or for any other matters for which we have no control) which may arise, except to the extent caused by our negligence.

You shall keep the property and all furniture, fixtures, fittings and effects in, on or at the property in the same state of repair as at the commencement of the holiday.

You shall leave the property in the same state of cleanliness and general order in which it was found.

You must report and pay to us the cost of any damage or breakages made during your holiday.

You must pay to us the cost of any additional cleaning deemed necessary due to your failure to maintain the property in the same state of cleanliness and general order in which it was found.

Access to land surrounding the cottages shall be done so in accordance with the Scottish Outdoor Access Code. You may read it in full here: www.outdooraccess-scotland.scot.

You must not to do anything that will or might vitiate in whole or in part any insurance in respect of the property, or increase the insurance premium.

We reserve the right to make a reasonable charge where you have contravened our request that the property be smoke-free.

You accept that the access roads to the properties are untarred roads and that you shall drive according to the conditions of both the road and the weather.

Your right to occupy the property may be forfeited without compensation if:

More people or pets than declared at the time of requesting a booking attempt to take up occupation of the accommodation.

You permit any overnight guests to be entertained without our express permission.

You carry out any activity which is illegal (whether actionable or not) or may cause unreasonable damage, noise, behaviour, inconvenience, or disturbance.

You or any member of your party smoke inside the property.

In the event of the property becoming unavailable (such as, but not limited to, fire or flooding), we will endeavour to provide you with alternative accommodation or will refund all monies paid (or a proportion in the case of curtailment).

We will not pay any compensation or expenses as a consequence of such an event.

No pets other than dogs are allowed in the property without our express permission, which may be given subject such terms as we may communicate to you in advance of your booking.

Each dog that you intend to bring with you on your holiday must be notified to us at the time of requesting a booking.

Where you bring any dog or dogs on your holiday, there is an additional charge of £25.00 per dog (to a maximum of 2 dogs).

If you exceed the agreed number of dogs we retain the right to refuse you access to the property, and/or to ask that you leave the property before the end of the booking period.

Registered assistance dogs are allowed in all properties.

We are unable to guarantee that any property has been pet free prior to your stay, and cannot accept responsibility for any allergy-related suffering as a result.

In addition, the following terms apply:

Dogs are not allowed on sofas, beds or other furniture.

Dog beds are not provided.

Dogs must not be left alone in or at the property or elsewhere at any time.

Dogs must be free from parasites and fleas before they occupy the property. Failure may incur subsequent charges.

Dogs should be kept on a lead at all times.

You will be liable for any damage caused by your dog, or any additional cleaning required.

Smoking is prohibited in all properties.

Smoking is allowed outside, however we ask that you be respectful of other guests and ensure smoke does not blow back inside the accommodation.

Cigarette butts must be extinguished completely and disposed of in a waste bin.

There is car parking at each property.

Cars are parked at your own risk.

Our properties have outdoor hot tubs.

Children must be supervised at all times.

If you have had or are suffering from severe allergies, ill health, a particular medical condition or are pregnant we advise you to speak to your GP prior to arrival to ensure you can use our facilities.

Guests should be aware that they are responsible for their own safety in and around the hot tub.

We shall be allowed access to the property at any reasonable time during any holiday occupancy.

We shall not be liable to refund any payments made for bookings cancelled as a result of force majeure.

Complaints should be brought to our attention at the earliest opportunity. It is important that this is done whilst you are still at the property, so that we can help and action can be taken.

These Terms and Conditions are governed by Scots law, and any legal claim will be subject to the jurisdiction of Scottish courts

Houses & Cottages

A payment of 50% of the total reservation is required at the time of booking to confirm the reservation. This is a refundable deposit if your booking is cancelled more than 6 weeks prior to the arrival date. If you cancel after this point the deposit is non refundable. If you book within 6 weeks of the arrival date, full payment will be taken and this is non refundable.

If you choose our pre-paid non refundable rate. Full payment is taken at the time of booking and is non refundable.

In the event that you require to cancel your booking, you must notify us as soon as possible. If you have chosen our pre-paid non refundable rate. Full payment is taken at the time of booking and is non refundable. If you have chosen our published best available rate, a payment of 50% of the total reservation is required at the time of booking to confirm the reservation. This is a refundable deposit if your booking is cancelled more than 6 weeks prior to the arrival date. If you cancel after this point the deposit is non refundable. If you book within 6 weeks of the arrival date, full payment will be taken and this is non refundable.

Once your booking is confirmed, you are responsible for the full cost of the holiday, less any deposit already received by us. The balance shall be paid not later than six weeks prior to your arrival. For bookings made less than six weeks prior to your arrival, the full cost of the holiday must be paid at the time of booking. We reserve the right to re-let any accommodation you have booked where any monies due are more than 7 days in arrears. If we are unable to re-let the accommodation you have booked, you will remain liable for the outstanding balance.

Exclusive Use & Private Events

A payment of 25% of the total event is required at the time of booking to confirm the reservation. This is a non refundable deposit.

In the event that you require to cancel your booking, you must notify us as soon as possible in writing.

20% of the total event is due 10 months prior to the event date. This is a non refundable payment.

Final balance is due 2 months prior to the event date. This is a non refundable payment.

General Information

Although every effort has been made to ensure the accuracy of the information set out on our websites and marketing campaigns, we cannot accept responsibility for any errors or omissions, and reserve the right to vary, amend, supplement or cancel any of the information or offers featured on our websites or email campaigns or otherwise at any time. All details are correct at time of going to print, however may be subject to change from time to time.

Penicuik Estate LLC shall not be responsible for any loss or damage which you may suffer arising out of events beyond its control or the control of its suppliers (including, without limitation, fire, failure of electrical, gas or other power supplies, strikes, industrial action, terrorist activity, technical problems with transport, illness of entertainers and bad weather), nor for any curtailment, cancellation or change to any accommodation, activity or itinerary or any other consequences which arise as a result of such events.
